If you believe your marriage has broken down, you may be considering whether to commence divorce proceedings.
The breakdown of a marriage is often a stressful and emotional time. We are here to help. We provide prompt, effective legal advice and practical solutions to the issues, concerns and questions that you will almost certainly encounter.
As a firm of specialist London divorce solicitors, we are dedicated to understanding and achieving your objectives, promptly, sympathetically and cost-effectively.
The majority of divorces are undefended which allows the divorce to proceed amicably and relatively expediently.
Only in those rare circumstances where one party does not consent to the divorce will court attendance be necessary.
Whether the divorce is consented to or not, the divorce can only proceed if one partner can show that the marriage has irretrievably broken down.
To do this, the person applying for the divorce (the petitioner) must prove one of the following:
(1) Their husband/wife has committed adultery;
Their husband/wife’s behaviour has been unreasonable (often there are relatively mild examples, which are agreed by both)
Their husband/wife has deserted them (it must be shown that their partner left without consent over 2 years ago)
(4) They have been separated from their partner for a minimum of 2 years and their partner consents to the divorce
(5) They have been separated from their partner for at least 5 years
We would be pleased to discuss the options available to you and to draft the necessary Court documentation for you.
